We,
a
group
of
10+
people,
reserved
a
place
to
celebrate
the
birthday
of
a
friend.
For
that
occasion,
we
brought
a
special
bottle
of
Italian
wine
as
a
birthday
present
and
asked
an
employee
if
it
would
be
okay
to
toast
with
it
while
consuming
other
drinks
from
the
restaurant.
I
believe
the
owner
was
unaware
of
the
situation
because
when
he
discovered
the
bottle
a
few
minutes
later,
he
reacted
highly
inappropriate.
He
unlawfully
confiscated
the
present
from
the
Birthday
Boy
and
emptied
the
bottle
without
any
prior
warning
in
front
of
his
eyes.
To
justify
his
strong
reaction,
he
accused
us
of
ignoring
the
law
of
which
we
were
fully
aware.
Despite
our
efforts
to
comprehend
his
behaviour
and
explain
ourselves,
the
owner
became
overly
aggressive
and
did
not
even
let
us
finish
our
sentences.

of
the
legal
basis
to
which
I
also
referred
during
the
“discussion”
with
the
owner:
„The
confiscation
and
annihilation
of
drinks
brought
in
by
the
guest
is
an
infringement
of
the
guest's
property
rights
and
therefore
not
allowed
and
can
be
punished
as
property
damage
according
to
§
303
of
the
German
Criminal
Code."
Furthermore,
such
an
action
would
violate
the
restaurant
law
(see
Cologne
District
Court
(Az
.:
203
C
6/16)
and
section
9
of
the
Restaurant
Act
(GastG)).
I
would
recommend
Mr.
Lynch
to
inform
himself
about
the
legal
situation
before
insulting
and
accusing
others
of
ignorance,
talking
to
his
employees
first,
then
speak
to
the
guests,
explain
them
his
point
of
view
and
listen
to
them
also.
He
may
want
to
suggest
charging
a
fee,
BUT
NEVER
EVER
touch
and
wilfully
destroy
the
property
of
guests.
I
am
sure,
that
with
a
more
appropriate
reaction
of
the
owner,
we
would
have
found
a
solution
which
would
have
satisfied
everybody.
But
under
these
violations
and
circumstances,
for
me
and
a
bunch
of
others,
it
was
the
last
time
being
there,
unless
the
owner
will
compensate
for
the
damage
he
has
caused
(65€).
